CONCERNING APPLICATIONS FOR CONSENT UNDER SECTION 53 OF THE PLANNING ACT, 1990
TAKE NOTICE THAT THE COMMITTEE OF ADJUSTMENT FOR CONSENTS WILL HOLD A HYBRID PUBLIC MEETING ON
February 27, 2025 at 2:00 p.m.
This meeting will be held in a Hybrid format in accordance with Section 238 of the Municipal Act, and the Town’s Procedure By-law, which provide for Electronic Participation.
Members of the public wishing to comment are strongly encouraged to make a written submission any time prior to the hearing by emailing planning@bracebridge.ca.  Members of the public wishing to make oral submissions to the Committee may do so by attending the Council Chambers at 1000 Taylor Court or Electronically through Zoom.  A link to the Zoom meeting and instructions on how to participate will be made available to the public on February 24, 2025 at: https://bracebridge.civicweb.net/filepro/documents/29703 or by going to the Town's Council and Committee Calendar.

CONSENT APPLICATION NO. D10-25/24 through D10-29/24

 EXPLANATION OF THE PURPOSE AND EFFECT OF THE CONSENT APPLICATION

Five (5) applications for consent have been submitted for the lands located at 2002 Rocky Narrows Road and legally described as part of Lots 27 and 28, Concession 8, Draper Ward, Town of Bracebridge.  The subject lands are approximately 13.68 hectares (33.8 acres) in area with approximately 566 metres (1,857.0 feet) of linear frontage on Rocky Narrows Road and 776 metres (2,545.9 feet) of frontage on the Muskoka River.  If approved, the applications would result in five (5) severed parcels and one retained parcel. The future lots are proposed to be accessed by Rocky Narrows Road.  Rights-of-way for access have been applied for over the lots containing the private portions of the road that are not on the subject lands and therefore are not part of these applications. Additionally, a 12 metre wide right-of-way is proposed over the retained lot, in favour of the five (5) severed lots, which is part of these applications.

CONSENT APPLICATION NO. D10-30/24 & D10-31/24

 EXPLANATION OF THE PURPOSE AND EFFECT OF THE CONSENT APPLICATION

Consent applications D10-30/24 and D10-31/24 proposed to create rights-of-way over the existing private portion of Rocky Narrows Road where it crosses the properties municipally known as 2323 and 2269 Highway 118 East.  The rights-of-way will be in favour of 2002 Rocky Narrows Road, which is the subject of consent applications D10-25/24 through D10-30/24 for the creation of new lots.

The proposed rights-of-way are a minimum of 12 metres (39.4 feet) wide, increasing to a maximum of 16.5 metres (54.1 feet) wide.

CONSENT APPLICATION NO. D10-45/24 & D10-46/24

MARKLE/SHEPPARD - ROLL NUMBER 050 009 062 00

 EXPLANATION OF THE PURPOSE AND EFFECT OF THE CONSENT APPLICATION

Two applications for consent have been submitted for the lands located at 1559 Highway 118 East and legally described as part of Lot 9, Concession 7, Draper Ward, Town of Bracebridge, being Parts 1 and 2 of 35R-20630.  The subject lands are approximately 23.25 hectares (57.5 acres) in area with 480.5 metres (1,576.4 feet) of frontage on the Muskoka River and 432.12 metres (1,417.7 feet) of frontage on Highway 118 East.  If approved, the applications would result in two severed parcels and one retained parcel.

Severed lot 1 would be approximately 4.05 hectares (10.0 acres) in area with 150 metres (492 feet) of frontage on Highway 118 East.  Severed lot 2 would be approximately 4.12 hectares (10.2 acres) in area with 150 metres (492 feet) of frontage on Highway 118 East.  The resultant retained lot would be approximately 15.09 hectares (37.3 acres) in area with 132.12 metres (433.5 feet) of frontage on Highway 118 East and 480.5 metres (1,576.4 feet) of frontage on the Muskoka River.

The application also proposes to create a right-of-way for access by a shared driveway over the retained lot in favour of severed lot 1.

CONSENT APPLICATION NO. D10-50/24

WAHL - ROLL NUMBER 050 003 036 00

 EXPLANATION OF THE PURPOSE AND EFFECT OF THE CONSENT APPLICATION

An application for consent has been submitted for the lands located at 1496 Uffington Road and legally described as part of Lot 20, Concession 2, Draper Ward, Town of Bracebridge.  The subject lands are approximately 11.9 hectares (29.5 acres) in area with approximately 290.5 metres (953.2 feet) of frontage on Uffington Road.  If approved, the application would result in one severed parcel and one retained parcel.

The severed lot would be approximately 5.9 hectares (14.7 acres) in area with 145.2 metres (476.6 feet) of frontage on Uffington Road.  The resultant retained lot would be approximately 5.9 hectares (14.7 acres) in area with 145.2 metres (476.6 feet) of frontage on Uffington Road.

ADDITIONAL INFORMATION relating to the application can be obtained by contacting the Planning Services Branch of the Planning and Development Department via planning@bracebridge.ca. A Notice of this application has been circulated to all property owners within 60 metres (200 feet) of the subject properties and to the appropriate persons and public bodies according to Ontario Regulation 197/96 under the Planning Act.

ANY PERSON OR AGENCY may make written submissions to the Town of Bracebridge either in support of or in opposition to the proposed consent by emailing planning@bracebridge.ca.
A copy of the decision will be sent to the applicant and to each person who filed with the Town a written request for notice of the decision.

If you wish to be notified of the decisions in respect of these applications, you must submit a written request to the Town of Bracebridge (planning@bracebridge.ca). This will also entitle you to be advised of a possible Ontario Land Tribunal Hearing. Even if you are the successful party, you should request a copy of the decision since the decision may be appealed to the Ontario Land Tribunal by the applicant, the Minister or a specified person or public body as defined by the Planning Act that has an interest in the matter. Members of the public are no longer able to appeal Consent decisions to the Ontario Land Tribunal, as a result of changes made to the Planning Act by Bill 23 on November 28, 2022.
