NOTICE FOR PUBLIC HEARING

CONCERNING APPLICATIONS FOR CONSENT UNDER SECTION 53 OF THE PLANNING ACT, 1990
TAKE NOTICE THAT THE COMMITTEE OF ADJUSTMENT FOR CONSENTS WILL HOLD A HYBRID PUBLIC MEETING ON
January 30, 2025 at 2:00 p.m.

This meeting will be held in a Hybrid format in accordance with Section 238 of the Municipal Act, and the Town’s Procedure By-law, which provide for Electronic Participation.

Members of the public wishing to comment are strongly encouraged to make a written submission any time prior to the hearing by emailing planning@bracebridge.ca.  Members of the public wishing to make oral submissions to the Committee may do so by attending the Council Chambers at 1000 Taylor Court or Electronically through Zoom.  A link to the Zoom meeting and instructions on how to participate will be made available to the public on January 27, 2025 at: https://bracebridge.civicweb.net/filepro/documents/29703 or by going to http://calendar.bracebridge.ca/council.

CONSENT APPLICATION NO. D10-01/25 & D10-02/25

ABD ELSHEHIED - ROLL NUMBER 040 001 055 & 040 001 055 02

 EXPLANATION OF THE PURPOSE AND EFFECT OF THE CONSENT APPLICATION

Two (2) applications for consent have been submitted for the lands located at 247 Maple Street and legally described as part of Lot 5, Concession 2, Macaulay Ward, Town of Bracebridge, being Part 1 of Plan 35R-26727 save and except Part 1 of 35R-27384, and Part 2 of 35R-26727 save and except Part 2 of 35R-27384. Lots 1 and 2, being the western proposed severed and retained lots, are each proposed to be 333.69 square metres (3,592 square feet) in area with 10.06 metres (33.0 feet) of frontage on Maple Street. Lots 3 and 4, being the eastern proposed severed and retained lots, are each proposed to be 332.99 square metres (3,584 square feet) in area with 10.06 metres (33.0 feet) of frontage on Maple Street. If approved, the applications would result in two severed parcels and two retained parcels.

CONSENT APPLICATION NO. D10-02/24 & D10-03/24

WAGNER - ROLL NUMBER 050 009 090 00

 EXPLANATION OF THE PURPOSE AND EFFECT OF THE CONSENT APPLICATIONS

Two (2) applications for consent have been submitted for the lands located at 1005 Matthiasville Road and legally described as part of Lot 5, Concession 8, Draper Ward, Town of Bracebridge, being Parts 1, 3, 4, 5, 6, 7 and 9 of 35R-17472. The subject lands are approximately 16.6 hectares (41.0 acres) in area with approximately 268 metres (879 feet) of frontage on the Muskoka River, 454.8 metres (1,492 feet) of frontage on Trethewey’s Falls Road, 347.6 metres (1,140 feet) of frontage on Highway 118 East, and 45 metres (148 feet) of frontage on Matthiasville Road. If approved, the application would result in two (2) severed parcels and three (3) retained parcels, as well as a Right-of-Way for a shared driveway.

CONSENT APPLICATION NO. D10-53/24

1000696140 ONTARIO INC. - ROLL NUMBER 040 009 062 00

 EXPLANATION OF THE PURPOSE AND EFFECT OF THE CONSENT APPLICATION

An application for consent has been submitted for the lands located at 1290 Cedar Lane and legally described as part of Lot 6, Concession 3, Macaulay Ward, Town of Bracebridge, being Lot 145 on Registrar’s Compiled Plan 542 except Part 1 on 35R-4525. The subject lands are approximately 0.96 hectares (2.37 acres) in area with 72.7 metres (238.5 feet) of frontage on Cedar Lane. If approved, the application would result in one severed parcel and one retained parcel.


The severed lot is proposed to be approximately 0.46 hectares (1.14 acres) in area with 36.1 metres (118.4 feet) of frontage on Cedar Lane. The resultant retained lot would be approximately 0.50 hectares (1.24 acres) in area with 36.6 metres (120.1 feet) of frontage on Cedar Lane.

ADDITIONAL INFORMATION relating to the application can be obtained by contacting the Planning Services Branch of the Planning and Development Department via planning@bracebridge.ca. A Notice of this application has been circulated to all property owners within 60 metres (200 feet) of the subject properties and to the appropriate persons and public bodies according to Ontario Regulation 197/96 under the Planning Act.

ANY PERSON OR AGENCY may make written submissions to the Town of Bracebridge either in support of or in opposition to the proposed consent by emailing planning@bracebridge.ca.
A copy of the decision will be sent to the applicant and to each person who filed with the Town a written request for notice of the decision.

If you wish to be notified of the decisions in respect of these applications, you must submit a written request to the Town of Bracebridge (planning@bracebridge.ca). This will also entitle you to be advised of a possible Ontario Land Tribunal Hearing. Even if you are the successful party, you should request a copy of the decision since the decision may be appealed to the Ontario Land Tribunal by the applicant, the Minister or a specified person or public body as defined by the Planning Act that has an interest in the matter. Members of the public are no longer able to appeal Consent decisions to the Ontario Land Tribunal, as a result of changes made to the Planning Act by Bill 23 on November 28, 2022.

Take notice that an appeal to the Ontario Land Tribunal in respect to this consent application may be made by the applicant, the Minister or a specified person or public body as defined by the Planning Act that has an interest in the matter by filing a notice of appeal with the Secretary-Treasurer either via the Ontario Land Tribunal e-file service (first-time users will need to register for a My Ontario Account) at https://olt.gov.on.ca/e-file-service by selecting Town of Bracebridge as the Approval Authority or by mail to the Planning and Development Department, Town of Bracebridge, 1000 Taylor Court, Bracebridge, ON, P1L 1R6 no later than 4:00 p.m. on the twentieth day after the Notice of Decision has been issued. The filing of an appeal after 4:00 p.m., in person or electronically, will be deemed to have been received the next business day. The appeal fee of $1,100 can be paid online through efile or by certified cheque/money order to the Minister of Finance, Province of Ontario. If you wish to appeal to the Ontario Land Tribunal (OLT) or request a fee reduction for an appeal, forms are available from the OLT website at www.olt.gov.on.ca. If the e-file portal is down, you can submit your appeal to planning@bracebridge.ca.
