EXPLANATION OF THE PURPOSE AND EFFECT OF THE PROPOSED MINOR VARIANCE
The minor variance application was submitted in order to construct a dwelling and to recognize the location of an existing dock.
Specifically, the applicants are requesting relief from Section 3.2.3.1 of Comprehensive Zoning By-law 2016-088 in order to permit a dwelling in the Residential Type One (R1) zone with the following variances:
- A front yard setback of 2.5 metres (8.2 feet), whereas the Zoning By-law requires a minimum 7.5 metre (24.6 foot) front yard setback; and
- A setback of 9.5 metres (31.2 feet) from the centreline of the road, whereas the Zoning By-law requires a minimum 17.5 metre (57.4 foot) front yard setback from the centreline of the road.
The applicants are also requesting relief from Section 4.21.4 of Comprehensive Zoning By-law 2016.0-088 in order to permit a dwelling in the Residential Type One (R1) zone with a setback from the top of bank of a slope of 40% or greater of 5.0 metres (16.4 feet), whereas the zoning By-law requires a minimum setback of 15.0 metres (49.2 feet) from the top of bank of a slope of 40% or greater.
The applicants are also requesting relief from Section 4.4.1 iii) of Comprehensive Zoning By-law 2016.0-088 in order to permit a dock with a setback from the extension of the side lot line of 0.53 metres (1.74 feet), whereas the zoning By-law requires a minimum setback of 5.0 metres (16.40 feet) from the extension of the side lot line.
