NOTICE OF APPLICATION FOR CONSENT UNDER SECTION 53 OF THE PLANNING ACT, 1990

TWO (2) APPLICATIONS considered to be complete have been received by the Town of Bracebridge for the property legally described as part of Lot 9, Concession 5, Macaulay Ward, Town of Bracebridge, being Parts 1 & 2 on Plan 35R-6437 and for the property legally described as part of Lot 9, Concession 5, Macaulay Ward, Town of Bracebridge, being Parts 1 & 2 on Plan 35R-2694 and Part 1 on Plan 35R-3218.

 

PURSUANT TO By-law 2022-100, “Delegated Authority Consents”, where no written objections have been received by the Town of Bracebridge or written objections are received that can be resolved between the objector and the applicant, or otherwise addressed or satisfied by a condition of provisional consent, the Director of Planning of Development will render a decision on the proposed application. Where written objections are received by the Town of Bracebridge that cannot be resolved, the application will be brought forward for consideration by the Committee of Adjustment for Consent with the applicant and any objecting persons being notified of when the application will be heard by the Committee.

The following applications will be considered:

CONSENT APPLICATION NO. D10-36/24 & D10-37/24

1232 & 1244 ROSWARNE DRIVE - ROLL NUMBERS 4418 040 009 093 00 & 4418 040 009 094 00 

 EXPLANATION OF THE PURPOSE AND EFFECT OF THE CONSENT APPLICATION

Applications for consent have been submitted for the property at 1232 Rosewarne Drive legally described as part of Lot 9, Concession 5, Macaulay Ward, Town of Bracebridge, being Parts 1 & 2 on Plan 35R-6437 and for the property at 1244 Rosewarne Drive legally described as part of Lot 9, Concession 5, Macaulay Ward, Town of Bracebridge, being Parts 1 & 2 on Plan 35R-2694 and Part 1 on Plan 35R-3218. The applications were submitted for the purposes of reciprocal easements for necessary access to the Stormwater Pond to facilitate stormwater management on the lands.


The subject lands for application D10-36/24, being 1232 Rosewarne Drive, are approximately 0.4 hectares (0.98 acres) in area. The application proposed to grant an easement over Parts 3 and 4 on the enclosed consent sketch in favor of the adjacent lot located at 1244 Rosewarne Drive.


The subject lands for application D10-37/24, being 1244 Rosewarne Drive, are approximately 2.4 hectares (5.9 acres). The application proposed to grant an easement over Part 2 on the enclosed consent sketch in favor of the adjacent lot located at 1232 Rosewarne Drive.

A decision on these applications will be made NO EARLIER THAN NOVEMBER 15, 2024 (14 days from date of notice).  Any submissions regarding this application must be made in writing before this date.

ADDITIONAL INFORMATION relating to the application can be obtained by contacting the Planning Services Branch of the Planning and Development Department via planning@bracebridge.ca. A Notice of this application has been circulated to all property owners within 60 metres (200 feet) of the subject properties and to the appropriate persons and public bodies according to Ontario Regulation 197/96 under the Planning Act.

ANY PERSON OR AGENCY may make written submissions to the Town of Bracebridge either in support of or in opposition to the proposed consent by emailing planning@bracebridge.ca.

A copy of the decision will be sent to the applicant and to each person who filed with the Town a written request for notice of the decision.

If you wish to be notified of the decisions in respect of these applications, you must submit a written request to the Town of Bracebridge (planning@bracebridge.ca). This will also entitle you to be advised of a possible Ontario Land Tribunal Hearing. Even if you are the successful party, you should request a copy of the decision since the decision may be appealed to the Ontario Land Tribunal by the applicant, the Minister or a specified person or public body as defined by the Planning Act that has an interest in the matter. Members of the public are no longer able to appeal Consent decisions to the Ontario Land Tribunal, as a result of changes made to the Planning Act by Bill 23 on November 28, 2022.
