NOTICE OF APPLICATION FOR CONSENT UNDER SECTION 53 OF THE PLANNING ACT, 1990

AN APPLICATION considered to be complete has been received by the Town of Bracebridge for the property known as part of Lots 2 & 3, Concession 10, Macaulay Ward, Town of Bracebridge, being Parts 4 of Plan 35R-13317.

PURSUANT TO By-law 2022-100, “Delegated Authority Consents”, where no written objections have been received by the Town of Bracebridge or written objections are received that can be resolved between the objector and the applicant, or otherwise addressed or satisfied by a condition of provisional consent, the Director of Planning of Development will render a decision on the proposed application. Where written objections are received by the Town of Bracebridge that cannot be resolved, the application will be brought forward for consideration by the Committee of Adjustment for Consent with the applicant and any objecting persons being notified of when the application will be heard by the Committee.

1064 MOORE ROAD - ROLL NUMBER 040 022 002 06

 EXPLANATION OF THE PURPOSE AND EFFECT OF THE CONSENT APPLICATION

An application for consent has been submitted for the lands located at 1064 Moore Road and legally described as part of Lots 2 & 3, Concession 10, Macaulay Ward, Town of Bracebridge, being Parts 4 of Plan 35R-13317. The application was submitted for the purpose of granting an easement for hydro infrastructure in favour of an abutting lot located at 1060 Moore Road and legally described as part of Lot 2, Concession 10, Macaulay Ward, Town of Bracebridge being Part 5 on Plan 35R-13317.


Consent application D10-04/24 received provisional approval on April 8, 2024 for the creation of a right-of-way over 1064 Moore Road to provide access from Moore Road in favour of 1060 Moore Road (formerly assigned civic address 2261 Manitoba Street). The proposed easement for hydro would be in the same location as the right-of-way and would accommodate a single pole near Moore Road and an underground hydro line. The proposed easement is 7 metres (23 feet) in width and has an area of approximately 714 square metres (7,685 square feet).

ADDITIONAL INFORMATION relating to the application can be obtained by contacting the Planning Services Branch of the Planning and Development Department via planning@bracebridge.ca. A Notice of this application has been circulated to all property owners within 60 metres (200 feet) of the subject properties and to the appropriate persons and public bodies according to Ontario Regulation 197/96 under the Planning Act.

ANY PERSON OR AGENCY may make written submissions to the Town of Bracebridge either in support of or in opposition to the proposed consent by emailing planning@bracebridge.ca.
A copy of the decision will be sent to the applicant and to each person who filed with the Town a written request for notice of the decision.

If you wish to be notified of the decisions in respect of these applications, you must submit a written request to the Town of Bracebridge (planning@bracebridge.ca). This will also entitle you to be advised of a possible Ontario Land Tribunal Hearing. Even if you are the successful party, you should request a copy of the decision since the decision may be appealed to the Ontario Land Tribunal by the applicant, the Minister or a specified person or public body as defined by the Planning Act that has an interest in the matter. Members of the public are no longer able to appeal Consent decisions to the Ontario Land Tribunal, as a result of changes made to the Planning Act by Bill 23 on November 28, 2022.
