NOTICE OF APPLICATION FOR CONSENT UNDER SECTION 53 OF THE PLANNING ACT, 1990

TWO (2) APPLICATIONS considered to be complete have been received by the Town of Bracebridge for the property legally described as part of Lot 13, Concession 4, Monck South Ward, Town of Bracebridge, being Reserve C and Part Reserve A, Plan 11, Parts 1-7 on Plan 35R-26085, Parts 1-5, 18, 19, and 41 on Plan 36R-27145 and for the property legally described as part of Lots 12 and 13, Concession 4, Monck South Ward, Town of Bracebridge, being Part Reserve A, Plan 11, Parts 4 and 9 on Plan 35R-26082, Part 1 and part of Part 2 on Plan 35R-26101, part of Parts 1 and 16 on Plan 35R-26105. 

PURSUANT TO By-law 2022-100, “Delegated Authority Consents”, where no written objections have been received by the Town of Bracebridge or written objections are received that can be resolved between the objector and the applicant, or otherwise addressed or satisfied by a condition of provisional consent, the Director of Planning of Development will render a decision on the proposed application. Where written objections are received by the Town of Bracebridge that cannot be resolved, the application will be brought forward for consideration by the Committee of Adjustment for Consent with the applicant and any objecting persons being notified of when the application will be heard by the Committee.

 EXPLANATION OF THE PURPOSE AND EFFECT OF THE CONSENT APPLICATIONS

Applications for consent have been submitted for the lands containing portions of Bangor Lodge Road and Waldmere Road, and legally described as part of Lot 13, Concession 4, Monck South Ward, Town of Bracebridge, being Reserve C and Part Reserve A, Plan 11, Parts 1-7 on Plan 35R-26085, Parts 1-5, 18, 19, and 41 on Plan 36R-27145 and for the property legally described as part of Lots 12 and 13, Concession 4, Monck South Ward, Town of Bracebridge, being Part Reserve A, Plan 11, Parts 4 and 9 on Plan 35R-26082, Part 1 and part of Part 2 on Plan 35R-26101, part of Parts 1 and 16 on Plan 35R-26105. The applications were submitted for the purposes of a lot addition in favour of an abutting property located at 1215 Waldmere Road and to create a right-of-way for access in favour of the lot addition over existing private roads leading to Bowyer’s Beach Road. The application proposes to preserve any and all existing rights-of-way.
There are two subject properties involved in these applications as multiple lot additions in this area have fragmented the original Waldmere 2015 Ltd. lands. The subject lands in D10-32/24 are approximately 7.4 hectares (18.3 acres) in area with no water frontage and contain portions of Waldmere Road and the entirety of Hamilton Point Road. The proposed severed lot, to be added to the abutting lot described above, is approximately 0.74 hectares (1.8 acres) in area with no water frontage and 145 metres (476 feet) of combined frontage on two sections of Waldmere Road.
The subject lands in D10-35/24 are approximately 2.99 hectares (7.4 acres) with no water frontage and contain portions of Waldmere Road and Bangor Lodge Road. The application proposed to create a right-of-way over Waldmere Road and Bangor Lodge Road in favour of the proposed severed lot in D10-32/24, to ensure legal access for 1215 Waldmere Road.
No new lots are proposed to be created.

ADDITIONAL INFORMATION relating to the application can be obtained by contacting the Planning Services Branch of the Planning and Development Department via planning@bracebridge.ca. A Notice of this application has been circulated to all property owners within 60 metres (200 feet) of the subject properties and to the appropriate persons and public bodies according to Ontario Regulation 197/96 under the Planning Act.

ANY PERSON OR AGENCY may make written submissions to the Town of Bracebridge either in support of or in opposition to the proposed consent by emailing planning@bracebridge.ca.
A copy of the decision will be sent to the applicant and to each person who filed with the Town a written request for notice of the decision.

If you wish to be notified of the decisions in respect of these applications, you must submit a written request to the Town of Bracebridge (planning@bracebridge.ca). This will also entitle you to be advised of a possible Ontario Land Tribunal Hearing. Even if you are the successful party, you should request a copy of the decision since the decision may be appealed to the Ontario Land Tribunal by the applicant, the Minister or a specified person or public body as defined by the Planning Act that has an interest in the matter. Members of the public are no longer able to appeal Consent decisions to the Ontario Land Tribunal, as a result of changes made to the Planning Act by Bill 23 on November 28, 2022.
