EXPLANATION OF THE PURPOSE AND EFFECT OF THE PROPOSED ZONING BY-LAW:
The zoning amendment proposes to amend the Town of Bracebridge’s Comprehensive Zoning By-law 2016-088 by changing the zoning on part of the subject lands from the present zone of Residential Type 1 (R1) to Residential Type 1 Special – 66 (R1-66).
Consent Application D10-53/24 has been granted conditional approval on the subject lands, which resulted in one severed lot and one retained lot on the subject lands. The purpose of the rezoning is to fulfill a condition of Consent Application D10-53/24 to bring the severed lot into compliance with the Comprehensive Zoning By-Law 2016-088.
The existing Residential Type 1 (R1) zone permitted uses include Detached Dwelling or Group Home ‘A’ with permitted accessory uses of Home Occupation, Bed and Breakfast, Second Dwelling Unit and Backyard Hens.
Section 4.25.1 of Comprehensive Zoning By-law 20216-088 states that within the full service boundary, where municipal sanitary sewage service is not available, one detached dwelling may be erected on an existing lot provided:
- Municipal water service is available to service such lands, or detached dwelling; and
- A detached dwelling is a permitted use within the applicable zone and all the other relevant requirements of the Zoning By-law are met.
As the severed lot is not an existing lot, a zoning by-law amendment is required to permit development of the severed lot.
The proposed Residential Type 1 Special – 66 (R1-66) zoning permitted uses are all those uses in the Residential Type 1 (R1) subject to the following provision:
i. Notwithstanding Section 4.25, land can be used and buildings and structures can be erected or used in absence of municipal sanitary sewer services.
All other applicable provisions of the Residential Type (R1) zone shall continue to apply with respect to the lands located within the Residential Type 1 Special – 66 (R1-66) zone where applicable.
